Terms of Service

These Terms of Service ("Terms") govern your access to and use of El Signo, a digital signage service operated by Greg Greaves, a sole proprietor doing business as "El Signo," based in Ontario, Canada ("El Signo," "we," "us," or "our"). By creating an account or using our website, mobile applications, or Android TV application (collectively, the "Service"), you agree to these Terms. If you don't agree, don't use the Service.

1. What El Signo Is

El Signo lets you upload content (images, PDFs, and videos) and display it on screens using our Android application, paired with our web-based content management dashboard. You are responsible for the content you upload and display.

2. Accounts

You must provide accurate information when creating an account and keep your login credentials secure. You're responsible for all activity under your account. If you believe your account has been compromised, contact us immediately at support@elsigno.ca.

You must be legally able to enter into a contract to use the Service. The Service is intended for business use, not for individual consumers.

3. Your Content

You retain ownership of any content you upload to El Signo. By uploading content, you grant us a limited license to store, process, and display that content solely as necessary to provide the Service to you.

You're responsible for making sure you have the rights to any content you upload — including images, videos, logos, and any third-party material. Don't upload content that:

  • Infringes someone else's copyright, trademark, or other intellectual property rights
  • Is illegal, defamatory, obscene, or fraudulent
  • Contains malware or anything intended to disrupt the Service

We reserve the right to remove content or suspend accounts that violate this section, though we have no obligation to monitor content and are not responsible for what you or other customers display.

4. Billing and Payment

  • Free tier: El Signo offers one free screen per account, displayed with a watermark.
  • Paid screens: Additional screens are billed monthly per screen, at the rate shown in your dashboard at the time of purchase. Pricing may change; we'll do our best to give notice of changes affecting existing subscriptions.
  • Payment processing: All payments are processed by Stripe. We never see or store your full card number.
  • Proration: Adding or removing screens mid-billing-cycle is prorated automatically.
  • Cancellation: You can cancel at any time from your dashboard. There is no long-term contract. If you remove your last paid screen, you keep access until the end of your current billing period, after which your account reverts to the free tier.
  • Refunds: We don't offer automatic refunds for partial billing periods. If something's gone wrong on our end, or you're unhappy with the Service, contact support@elsigno.ca — we consider refund requests on a case-by-case basis and will act reasonably and in good faith.
  • Failed payments: If a payment fails, we'll attempt to collect it again automatically. Accounts with a persistently failed payment may be suspended, which adds a watermark to your screens and may block content updates until payment is resolved.

5. Acceptable Use

Don't use El Signo to:

  • Violate any law or regulation
  • Infringe anyone's intellectual property or privacy rights
  • Distribute malware, spam, or unsolicited commercial content through the Service
  • Attempt to gain unauthorized access to the Service, other accounts, or our infrastructure
  • Interfere with or disrupt the Service or servers/networks connected to it
  • Resell or sublicense access to the Service without our written permission

6. Service Availability

We aim to keep El Signo running reliably, but we don't guarantee uninterrupted or error-free operation. The Service is provided on an "as is" and "as available" basis. We may perform maintenance, and occasionally the Service may be unavailable as a result.

Devices running the El Signo Android app cache content locally, so a brief loss of internet connectivity at a venue generally doesn't interrupt what's already displaying — but this isn't a guarantee for extended outages.

7. Limitation of Liability

To the maximum extent permitted by law, El Signo (Greg Greaves) is not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, profits, or data, arising from your use of or inability to use the Service.

Our total liability for any claim arising from these Terms or the Service is limited to the amount you paid us in the three months before the claim arose. This limitation doesn't apply where prohibited by law, and nothing in these Terms excludes liability that can't be excluded under applicable Ontario or Canadian law.

8. Termination

You may stop using the Service and delete your account at any time by contacting support@elsigno.ca. We may suspend or terminate accounts that violate these Terms, with notice where reasonably possible. Upon termination, your right to use the Service ends, though provisions of these Terms that by their nature should survive (ownership, liability limits, governing law) will continue to apply.

9. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we'll make reasonable efforts to notify active customers (such as by email or an in-app notice). Continued use of the Service after changes take effect means you accept the updated Terms.

10. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. Any disputes will be subject to the exclusive jurisdiction of the courts of Ontario.
